Privacy Policy

neurOS ("we," "us," "our") operates the neurOS mobile application (the "App") and website at getneuros.app (the "Site"). This Privacy Policy explains what data we collect, why we collect it, how we use and protect it, and your rights regarding that data.

Geographic scope. The Service is offered and directed solely to residents of the United States who are at least 18 years of age. The Service is not directed to, offered to, or intended for users located in the European Economic Area, the United Kingdom, or any other jurisdiction outside the United States. By using the Service you represent that you are a U.S. resident and at least 18.

The short version: We collect behavioral and wellness data to power personalized ADHD coaching. We never sell your data. Your conversations with the AI coach are processed by Anthropic's Claude API. By default, your conversations are not used to improve neurOS — you can opt in to allow us to review them for product improvement in Settings. You can delete all your data at any time.

Thoughts you capture in the Brain Dump are stored locally on your device. They are only transmitted to our servers if you choose to share them with the AI coach during a conversation. Brain Dump is a free-form text field; users sometimes include sensitive personal information. Anything you do not choose to send to the coach remains on your device.

We do not use your data for advertising. We do not sell your data. By default, we do not use your conversations to improve or train our AI models. If you opt in via the "Help improve neurOS" setting, you authorize us to retain and review your conversations for product improvement. We do not currently use opt-in conversations for AI training; if we begin doing so, we will treat your consent setting at the time of use as authoritative. This setting is off by default and can be turned off at any time.

3. Third-Party Services

We share data with the following service providers, solely to operate the App:

Each provider operates under its own privacy policy and data processing agreements. We select providers with strong privacy commitments and data protection standards.

Legal disclosures. We may disclose your data when we believe in good faith that disclosure is necessary or appropriate to (i) comply with applicable law, regulation, subpoena, court order, or other legal process; (ii) respond to lawful requests from public authorities, including for national-security or law-enforcement purposes; (iii) protect the rights, property, or safety of neurOS, our users, or others; (iv) detect, prevent, or investigate fraud, abuse, security incidents, or violations of these Terms; or (v) enforce or defend our legal rights, including in connection with claims or litigation.

5. Data Security

No method of electronic storage or transmission is perfectly secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and applicable regulators to the extent and within the timeframes required by applicable law.

6. Your Rights

6.1 Access Your Data

All data you've provided is accessible through the App (check-ins, conversations, systems, insights).

6.2 Delete Your Data

You can request complete deletion of all your data at any time by emailing support@getneuros.app or by using the in-app account deletion option. We will delete data associated with your active account within 30 days of a verified request. This includes check-ins, conversations, systems, patterns, and account information. Deletion is permanent and cannot be undone. Residual copies of data may persist in encrypted backups, error monitoring, and application logs for up to ninety (90) days after deletion before they are overwritten or automatically purged in the ordinary course. We may also retain a limited record of the deletion request itself, and any data we are required to retain to comply with legal obligations, prevent fraud or abuse, or defend against legal claims.

You may request an export of your data in a machine-readable format by contacting us at the email above.

6.4 Opt Out of Notifications

You can disable all notifications at any time through the App's notification settings or your device settings.

6.5 California Residents (CCPA / CPRA)

If you are a California resident, you have the right to: know what personal information we collect, request access to and deletion of your data, request correction of inaccurate data, and opt out of the sale or sharing of your data. We do not sell or share personal information for cross-context behavioral advertising. We will respond to verifiable requests within 45 days, and may extend that period by an additional 45 days when reasonably necessary, with notice to you, as permitted by law. We may require information sufficient to verify your identity before fulfilling a request. To exercise these rights, email support@getneuros.app.

6.6 AI System Disclosure

The coaching responses in the App are generated by Anthropic, PBC's Claude foundation model, which neurOS accesses through Anthropic's commercial API. neurOS is a deployer of Anthropic's model and does not design, code, or substantially modify the underlying generative AI system. Anthropic's training-data and data-use practices for Claude are described in Anthropic's policies. As of the Effective Date, Anthropic does not use commercial-API inputs or outputs to train its foundation models. neurOS does not currently train any custom AI model on user data; if we begin doing so in the future, we will only use data from users whose "Help improve neurOS" setting is on at the time of use.

6.7 Washington Residents (My Health My Data Act)

If you are a Washington State resident, you have additional rights under the Washington My Health My Data Act (RCW 19.255) with respect to "consumer health data" we collect about you. Consumer health data includes mood, energy, focus, sleep quality, and behavioral-pattern information.

6.8 New York Residents

If you are a New York resident, you acknowledge that the Service uses an AI chatbot system. neurOS is not psychotherapy, mental health treatment, diagnosis, or counseling provided by a licensed professional, and interacting with the Service does not create a therapist-patient or counselor-client relationship.

6.9 Illinois Residents (BIPA)

The Service does not collect biometric identifiers or biometric information (fingerprints, voiceprints, retina or iris scans, or face/hand geometry) as defined by the Illinois Biometric Information Privacy Act. If we add any feature using such data in the future, we will obtain separate written consent before doing so.

7. Age Requirement

neurOS is offered solely to individuals who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it promptly and may suspend or terminate the associated account. If you believe someone under 18 has provided us with personal information, please contact us at support@getneuros.app.

8. Not Medical Advice & Crisis Disclaimer

neurOS is an AI-powered coaching tool, not a medical device, clinical treatment, or healthcare service. It does not diagnose, treat, cure, or prevent any medical condition. The coaching, patterns, and insights provided by neurOS are for informational and self-management purposes only and should never replace professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with questions about your health.

If you are experiencing a mental health emergency, suicidal thoughts, or thoughts of self-harm, do not rely on neurOS. Immediately contact emergency services (911 in the United States), call or text the 988 Suicide and Crisis Lifeline, or go to the nearest emergency room. neurOS is not designed for crisis intervention.

If we make material changes to how we use your data, we will notify you via the App or by email and update this policy accordingly. We use industry-standard de-identification techniques to reduce the risk of re-identification; no de-identification method is perfect, and we do not represent that de-identified data is incapable of re-identification under all circumstances.

10. Business Transfers

If neurOS is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or substantially all of its assets, your data may be transferred as part of that transaction. We will use commercially reasonable efforts to require any acquirer or successor to honor materially equivalent privacy commitments with respect to data collected before the transfer, or, where that is not feasible, we will provide notice of the transfer and a reasonable opportunity to delete your data before the transfer takes effect. A business transfer of this kind is not considered a "sale" of your personal information or consumer health data under California, Washington, or other applicable privacy laws.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App and updating the "Last Updated" date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised policy.
